On November 1 2017, the California board of equalization member, Fiona Ma, delivered a letter to the CA Governor’s office requesting that the Governor “request Amazon to assess/collect/remit sales tax on ALL of the FBA retailers who are fulfilling orders with Amazon in the State of California.”

Accompanying Ms. Ma’s letter was a letter by me (State Tax Counsel, Paul Rafelson) on behalf of marketplace sellers, reiterating the need for Marketplaces to be required to collect CA sales tax on all sales.

What does this have to do with responding to California Sales Tax letters?

Based on these letters, we’ve put together a template for Amazon FBA sellers, as a starting point for their response to California sales tax letters. This is how I would respond if I received a letter from CA. We recommend getting expert advice as each individual situation is different.
I would send the letters by certified mail to:
